P. Srinivas Rao, And Another, v. The State Of Ap Rep By Its Pp Hyd., And Another,
SMT JUSTI CE T.RAJANI CRI MI NAL PETI TON No.7 6 7 4 OF 2 0 1 2 ORDER:
This petition is filed, by the petitioners, seeking for quash of the proceedings against them in Crime No.152 of 2011 on the file of the Santoshnagar Police station, Hyderabad. The offences alleged are under Sections 306 and 511 IPC.
2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the 1st respondent. None appears for the 2nd respondent in spite of notice.
3.
The allegations in the complaint, as can be seen from the complaint, are that the father of the de facto complainant attempted to commit suicide and the reason for such attempt is stated to be the altercation that took place between the father of the complainant and the petitioner herein with regard to the wages of the father of the de facto complainant. The counsel submits that altercation cannot be considered as a factor leading to the attempted suicide by the father of the complainant. 4.
The Public Prosecutor does not raise any argument in counter to the contentions of the petitioners' counsel. 5.
On the face of it, the allegations do not attract the alleged offences. Mere altercation cannot be construed as an abetment for the suicide attempted by the father of the de facto complainant.
6.
Hence, in view of the above, this court opines that continuation of further proceedings against the petitioners would be an abuse of process of law.
7.
With the above observations, the Criminal Petition is allowed and the proceedings in Crime No.152 of 2011 on the file of the Santoshnagar Police station, Hyderabad, against the petitioners, are hereby quashed.
As a sequel, the miscellaneous applications, if any pending, shall stand closed.
