HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.4606 of 2017 ORDER :
Heard the learned counsel for the petitioners, who are A3 to A5 of Crime No.152 of 2016 of Tadikonda Police Station, Guntur District, registered for the offence punishable under Section 366 I.P.C. on the report of the de facto complainant dated 07.10.2016, who is father of the victim and learned Public Prosecutor representing the State before ordering notice to respondent No.2 and perused the contents of the F.I.R and remand report of A1.
As per the F.I.R., petitioner No.1/ A3 is brother of A1, petitioner No.2/ A4 is mother of A1, petitioner No.3/ A5 by name P.Lalaiah is mentioned along with the other accused is not even direct relative to them. It is mentioned that these three petitioners along with A2-Sekhar were supporting and instigating A1-Ala Sambaiah.
In the remand report, there is no specific overtacts insofar as the petitioners/ A3 to A5. From the allegations in the F.I.R, there is nothing to interdict the investigation. However, the petitioners/ A3 to A5 shall not be arrested pending investigation and this will not prevent the Police to
secure them for the purpose of investigation as and when required.
Accordingly, the Criminal Petition is disposed of. It is needless to say that the Police shall complete the investigation as early as possible and file final report. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
