THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21937 OF 2007 ORDER:

Heard the learned counsel for the petitioner and the learned Standing Counsel for respondents -Bank.

2. The present writ petition came to be filed seeking issuance of writ of mandamus declaring the inaction of respondents 1 and 2 in considering the claim made by the petitioner Company pursuant to the Policy No.2000-428 as illegal and arbitrary.

3. Though various grounds are raised in the affidavit filed in support of the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to respondents 1 and 2 to consider the claim petition made by the petitioner at the earliest.

4. Learned Standing Counsel for respondents 1 and 2 submits that since the number of the policy was not properly mentioned in the affidavit filed by the Managing Director of the petitionerCompany, his request could not be considered till date. However, he further submits that since the particulars of the policy have been traced, suitable steps would be taken in deciding the claim petition at the earliest.

5. Having regard to the statement made across the Bar, the Writ Petition is disposed of directing respondents 1 and 2 to dispose of the claim petition made by the petitioner in respect of Policy No.2000-428 taken at Himayatnagar Branch of Oriental Insurance Company, at the earliest, preferably within a period of

twelve (12) weeks from the date of receipt of a copy of this order. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
