The petitioner, who is the sole accused in Crime No.119 of 2016 of Vempalli Police Station, Kadapa District, filed the present Criminal Petition under Section 438 Cr.P.C., seeking release in the event of his arrest in connection with the above crime, registered for the offences punishable under Sections 498-A and 506 IPC and Sections 3 and 4 of Dowry Prohibition Act.
The averments in the First Information Report would show that the marriage of the informant was performed with the petitioner in the year 2006. They lived happily till 2013. Out of wedlock they blessed with one son and one daughter. It is stated that since last three years the petitioner developed illegal contacts and started harassing the informant for additional dowry of Rs.20.00 lakhs, for which the informant is alleged to have paid Rs.15.00 lakhs to the petitioner. It is further alleged that the petitioner used to quarrel with the informant and her parents for small issues and abuse them in filthy language. Though counseling took place, there was no change in the attitude of the petitioner. Hence, the report.
Heard learned counsel for the petitioner and Public Prosecutor appearing for the respondent-State.
As seen from the record, the marriage between the petitioner and informant took place in the year 2006 and the harassment is alleged to have commenced seven years later. A reading of the first information report show that the petitioner used to beat the informant and also demand her to get additional dowry of Rs.20.00 lakhs, out of which she
is alleged to have paid Rs.15.00 lakhs. Having regard to the nature of allegations made, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner, if so, advised shall surrender before the Court concerned and make an application for regular bail, in which event the same shall be considered on such terms as the Court deem fit, at the earliest.
