THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WP.No.9890 of 2018 ORDER :

Heard the counsel for petitioner, and the learned Government Pleader for Prohibition and Excise, for respondents. 2.

The counsel on both sides state that the issue raised in this Writ Petition is covered by the order dt.26.12.2017 passed in WP.No.44088 of 2017.

Therefore, for reasons alike, the present Writ Petition is disposed of directing the 2nd respondent to release the Mini Goods Carriage vehicle belonging to petitioner bearing registration No.AP-21-TZ-6629, subject to final orders to be passed in the Criminal proceedings, and on petitioner furnishing a fixed deposit of Rs.40,000/- from any nationalized bank in favour of the 2nd respondent, and also on production of original R.C. book and on petitioner further giving an undertaking that he will not transfer or alienate the vehicle to any third party in any manner and will maintain the vehicle in the same good road-worthy condition without changing its major parts and features, and would produce the same as and when directed to be produced before the competent authority. 4.

Accordingly, the Writ Petition is disposed of with the above directions. No order as to costs.
