HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3672 of 2018 ORDER:

This petition is filed under Section 482 Cr.P.C by the petitioners/A1 to A9 seeking to quash the proceedings against them in S.C.No. 214 of 2017 on the file of I Additional Sessions Judge at Nalgonda, registered for the offences under Sections 366(A), 417, 420, 509, 506, 342 and 323 r/w 109 IPC and Section 12 of Protection of Children from Sexual Offences Act, 2012.

As can be seen from the charge sheet, various allegations are leveled against all the accused showing the method and manner in which they allegedly subjected the de-facto complainant to cruelty. Of course, the veracity of the charge sheet allegations need to be determined only after full-fledged trial. However, having regard to the prima facie accusation contained in the charge sheet, it is not a fit case to quash the proceedings against any of the accused. Therefore, the petition is liable to be dismissed.

Learned counsel for petitioners/ accused 1 to 9 would submit that some of the accused are residing in different places far from the trial Court and some of them are ladies and therefore, their presence may be dispensed with. If petitioners/accused 1 to 9 are so advised, they can

UDPR,J Crl.P No. 3672 OF 2018 move an application before the trial Court for dispensing with their personal appearance, in which case, the trail Court shall pass an order on merits.
