This Criminal Petition is filed by the petitioners/A1 and A2 under Section 482 Cr.P.C seeking to quash the proceedings in F.I.R.No.223 of 2015 of Tirupathi East Police Station, Tirupathi Urban, registered for the offences punishable under Sections 427 r/w 34 I.P.C. and Section 3(i)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, which is an outcome of the report of the 2nd respondent/de facto complainant. Heard the learned counsel for the petitioners and also the respondent-State represented by the Public Prosecutor before admission and perused the material on record. Perused the material on record. As the material falls short for this Court to admit the application for quashing of F.I.R.
proceedings but for to say the factual matrix entitled to the concession of bail, this application is disposed of giving liberty to the petitioners to surrender before the learned Magistrate concerned and with affidavit of surrender, move for regular bail with notice to the Special Public Prosecutor before the learned Special Judge on same day and in such an event the learned Special Judge shall hear and grant bail on the same day with necessary conditions. The presence of accused pending investigation at post bail stage, before learned Magistrate can be dispensed with. Further remedies are left open in the event of police filing final report and cognizance taken by learned Magistrate. Accordingly, this criminal petition is disposed of. The miscellaneous petitions, if any pending, shall stand closed.
