HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Criminal Petition No.1845 of 2015 ORDER:

The defacto complainant and his Counsel Sri G.Shashidhar Reddy are present. A.1 to A.5 and A.7 to A.9 and their Counsel Sri Ch.Vidyasagar Rao are present.

On the report given by the defacto complainant, the Police of Malakpet P.S, Hyderabad registered a case in Crime No.444/2014 and after investigation laid charge-sheet against the accused for the offence under Sec.3(ii)(iv), (ix),(xv), SCs, STs (POA) Act 1989. The charge sheet was taken cognizance and registered as S.C.No.1 of 2015 and now pending on the file of VI Additional Metropolitan Sessions Court, Secunderabad.

While-so, today the defacto complainant and A.1 to A.5 and A.7 to A.9 appeared before this Court and submitted that accused and complainant are all permanent residents of same apartment namely Shailaja Pride Apartments, Moosarambagh, Hyderabad and due to unfortunate events, some disputes arose between them and now at the intervention of elders they have amicably resolved all their disputes and want to live in the same apartment in a peaceful manner and therefore, as per the agreement moved by the elders, the defacto complainant has no objection for quashment of proceedings against the petitioners/accused and therefore, this Court may be pleased to accord permission to them to compromise the matter and compound the offence and accordingly quash the proceedings in S.C.No.1 of 2015 on the file of VI Additional Metropolitan Sessions Court, Secunderabad in the interest of justice.

Having regard to the above submission and in view of the fact that the parties are all residents of the same apartment and now they want to lead a happy and peaceful life in an amicable manner and considering that no useful purpose will be served even if they are driven to trial since the chances of securing conviction are bleak as they have already compromised the issue and by following the

decision reported in Gian Singh vs. State of Punjab and another, this petition is allowed and permission is accorded to the parties to compound the offence and proceedings in S.C.No.1 of 2015 on the file of VI Additional Metropolitan Sessions Court, Secunderabad are quashed against A.1 to A.5 and A.7 to A.9 in terms of joint memo filed by the parties.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
