Heard Sri V.Rao Padala, learned counsel appearing for the petitioner and the learned Government Pleader for Employment and Training for the State of Andhra Pradesh appearing for the 2nd respondent.
2. The 1st respondent-College made a requisition to the 2nd respondent to sponsor candidates belonging to OC,
BC, SC and ST communities for the posts of Class IV (Animal Attendant). The grievance of the petitioner is that the respondents have not been receiving applications from the candidates other than those sponsored by the Employment Exchange. The present writ petition is therefore filed to direct the respondents to receive application form the petitioner for the post of Class IV (Animal Attendant) without insisting upon her name being sponsored by the Employment Exchange.
3. Reliance is placed by the learned counsel appearing for the petitioner on Excise Superintendent, Machilipatnam, Krishna District, A.P., v.
K.B.N.
Visweshawara Rao,[1] wherein the Supreme Court has laid down categorically that restricting the selection only to the candidates sponsored by Employment Exchange is not proper. In addition to requisitioning the names from Employment Exchange, names should also be called for by publication in newspapers, having wide circulation and display on office notice boards or announcement of radio, television and employment news bulletins.
4. In view of the above judgment of the Hon'ble Supreme Court, the respondents are under obligation to receive the application from the petitioner.
5. Therefore, the respondents are directed to receive the application from the petitioner and allow her to participate
in the selection process including the written test and interviews to the existing vacancies of Class IV (Animal Attendant) posts without insisting that her name must be sponsored by the employment Exchange. The writ petition is disposed of accordingly. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
