HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 41257 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the action of the respondents 4 to 7 in harassing the petitioner and his family members by calling to the Police Station and misbehaving at the instance of eighth and ninth respondents as illegal, arbitrary and violation of Article 14, 19 and 21 of the Constitution of India and consequently to direct the second respondent to do enquiry into the issue against the sixth and seventh respondents, who are harassing the petitioner and his family by calling them to police station in order to settle the dispute with the eighth respondent in the Police Station and to pass such other suitable orders as this Court may deem fit and proper in the circumstances of the case.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [AP] appearing for the respondents 1 to 5.

3. It is the case of the petitioner that the official respondents 4 and 5 under the influence of respondents 8 and 9 are interfering with the peaceful possession and enjoyment causing hardship.

4. Sri Ramesh Babu, Assistant Government Pleader for Home [AP] filed counter and on the weightage of the same, he submits that a case in Crime No. 2 of 2015 was registered for the offences punishable under section 417 IPC and Section 3 of Dowry Prohibition Act read with section 34 of IPC at Police Station

Nizampatnam on 09-2-2015 at 07:00 p.m., and the investigation is in progress and to get over the same the petitioner has filed this writ petition without co-operating with the investigation in spite of a specific direction in Crl.P.No. 9341 of 2015 passed by this Court to co-operate with the investigation.

5. The writ petition is dismissed. No costs.

6. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
