THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.96 of 2017 ORDER:

This writ petition is filed seeking a writ of Mandamus to declare the inaction of the respondent No.4 in issuing the proceedings in Lr.No.CESS/MD/F.Paybills/D.No.1709/2016, dated 26.11.2016 rejecting the case of the petitioners for reinstatement as arbitrary and illegal. A consequential direction is sought to reinstate the petitioners on par with unofficial respondent Nos. 5 to 7. Heard Sri Mohd. Asifuddin, learned counsel for the petitioners and Ch.Koteswara Rao, learned counsel for the unofficial respondents 5 to 7 and learned Government Pleader for the official respondents. The case of the petitioners is that they were appointed as casual workers during the years 2003 and 2007 and their services were disengaged by the respondent No.4-Society.

The respondents took a policy decision to regularize the services of such of those workers, who had continuously rendered service. Since the petitioners were disengaged, their services could not be regularized, and in identical circumstances, this Court in Writ Petition No.4095 of 2012 had granted interim directions vide orders dated 16.2.2012 in W.P.M.P.
