THE HON'BLE SMT JUSTI CE KONGARA VI JAYA LAKSHMI Writ Petition No.9286 of 2013 Order:

This Writ Petition is filed to declare the action of the respondents 1 and 2 in allowing the respondents 3 to 6 in making illegal constructions at the premises admeasuring 666.66 sq. yards, Municipal No.1-10-110, situated near Devi Theatre Cross Roads, Opp. Venu Oil Mill, Hyderabad Road, Nizamabad, and not demolishing the illegal constructions already made, as illegal and arbitrary.

No counter affidavit has been filed either by the official respondents or by the unofficial respondents. When the matter is taken up for hearing, learned Standing Counsel for the respondents 1 and 2 submits that no representation whatsoever has been filed by the petitioner complaining about the illegal construction being made by the unofficial respondents 3 to 6. Having regard to the facts and circumstances of the case, the petitioner is given liberty to file a representation to the official respondents 1 and 2 herein ventilating her grievances and on filing such representation the respondents 1 and 2 shall consider the same and pass appropriate orders thereon in accordance with law, after giving reasonable opportunity to both the petitioner and the unofficial respondents 3 to 6. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
