This Criminal Petition is filed seeking for quash of the proceedings against the petitioner, who is accused No.2 in C.C. No.1393 of 2010 on the file of IV Additional Chief Metropolitan Magistrate, Hyderabad. 2.

Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent.

A perusal of the complaint would show that there are specific allegations against this petitioner that he was also hand in glove with the other accused in manipulating and fabricating the documents. Hence, when there is prima-facie material against the petitioner, it would not be advisable to quash the proceedings against him. Hence, this Court finds that there is no need to interfere with the impugned order passed in Criminal Revision Petition No.165 of 2013 on the file of III Additional Metropolitan Sessions Judge at Hyderabad. But, however, considering the plea of the petitioner's counsel that the petitioner is old aged, finding it difficult to attend the Court on every date of adjournment, the Court below is directed not to insist upon the presence of the petitioner unless it is necessary for the proceedings of the case.

With the above directions, the Criminal Petition is disposed of. As a sequel, the miscellaneous applications, if any pending, shall stand closed. ___________________ T.RAJANI, J Date: 19.12.2017.
