THE HON'BLE SRI JUSTICE P. NAVEEN RAO Date: 25.6.2019 Between:

Smt.Sridevi Polavarapu .. Petitioner And State of Telangana, rep. by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and another.

.. Respondents The Court made the following:

THE HON'BLE SRI JUSTICE P. NAVEEN RAO ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Respondents and perused the material on record.

2.

Petitioner claims to have purchased land admeasuring Ac.1-10 guntas in Survey No.273-part, situated at S.R.Naik Nagar, Jeedimetla Gram Panchayat, Quthbullapur mandal, Ranga Reddy district from its original owner K.Ramakrishna and others under registered sale deed dated 2.1.2008 bearing Document No.59/08.

3.

On 12.8.2014, the Assistant Director, Survey and Land Records, Ranga Reddy district submitted a report, along with the sketch prepared, to the Executive Director, Telangana Industrial Infrastructure Corporation (TIIC) Limited, informing that survey work was completed in respect of Sy.No.50 of Gajularamaram and its adjacent Sy.Nos.273, and of Jeedimetla village of Quthubullapur mandal. According to the said report, the disputed area falls in Sy.No.50 of Gajularamaram to an extent of Ac.1-17 guntas. Along with the letter, copy of the report and the sketch prepared was enclosed. Aggrieved thereby, petitioner preferred appeal before the Commissioner of Survey and Land Records, Hyderabad on 8.2.2018. Alleging non-disposal of the said appeal, the present writ petition is filed.

4.

It appears that the dispute is between petitioner and TIIC, but the TIIC is not made as party to the writ petition. On 18.6.2019, when the matter was taken up, the learned Government Pleader was

directed to get instructions as to whether the appeal has been numbered. The learned counsel for petitioner informs the Court that the appeal was numbered and the same is pending before the 2nd respondent.

5.

If that being so, without expressing any opinion on the merits of the controversy, the writ petition is disposed of directing the 2nd respondent to consider the appeal said to have been filed by the petitioner questioning the report of the Inspector of Survey dated 11.8.2014 by affording opportunity to the petitioner as well as TIIC and pass appropriate orders, as per law, within a period of six weeks from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
