THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.21233 of 2017 ORDER:

The issue arises under Section 4(5) of the A.P.Assigned Lands (Prohibition of Transfers) Act, 1977 (for short 'the Act'). The petitioner complains inaction in considering and disposing of representation dated 11-01-2017 by the 4th respondent as illegal and amounts to refusing to exercise the jurisdiction conferred on the 4th respondent. I have perused the representation dated 11-01-2017 and also the grievance of petitioner.

Having regard to the nature of complaint that the assigned land is in possession of a person other than the assignee or person claiming through assignee, which is required to be examined and considered under Section 4(5) of the Act, the writ petition is disposed of by directing the 4th respondent to consider representation dated 11-01-2017 in accordance with law, afford opportunity to respondents 5 to 9 as well and dispose of the representation as expeditiously as possible, preferably within three months from the date of receipt of a copy of this order. The petitioner is given liberty to file present order copy by way of Memo and enclose the representation as well for timely consideration and disposal by the 4th respondent.

Miscellaneous petitions, if any, pending, shall stand closed. No order as to costs.
