THE HONOURABLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.12026 of 2019 ORDER:

This writ petition is filed challenging the action of respondent No.5 in calling the petitioner and witnesses to the police station daily without having any valid reason or cause.

Learned Government Pleader for Home produced written instructions stating that at the instance of one Baltha Rajamouli, a case in Crime No.36 of 2019 of Jannaram Police Station, was registered against the petitioner, who is A.1 in the said crime, and others and during investigation, the Station House Officer, Jannaram, tried to serve notice under Section 41-A Cr.P.C. to the accused persons, but, the petitioner, instead of receiving the notice, filed this writ petition with false and frivolous allegations.

It is to be seen that admittedly the petitioner is accused in Crime No.36 of 2019 and when the police tried to serve notice under Section 41-A Cr.P.C., the petitioner should have received the same instead of filing the writ petition.

Recording the submissions of the learned Government Pleader for Home, this writ petition is disposed of directing the respondent police not to interfere with the civil dispute pending between the petitioner and Baltha Rajamouli. However, this order will not preclude the respondent police to proceed with further investigation in Crime No.36 of 2019 and take action, in accordance with law.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. __________________________ A. RAJASHEKER REDDY, J 25th June 2019 mar
