Heard learned counsel for the petitioner and learned Assistant Government pleader.

Petitioner is aggrieved by the order of Revenue Divisional Officer, Armoor dated 15.07.2017 made under Section 5 (5) of the Telangana State Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act, 1971'), in allowing the appeal filed by the 6th respondent and setting aside the mutation order of the Tahsildar, Morthad and consequently, cancelled the pattadar pass book and title deed issued in favour of the petitioner. Aggrieved by the order of RDO, petitioner preferred revision before the Joint Collector, Nizamabad. According to learned counsel for the petitioner the said revision is pending. Petitioner also filed application to suspend the order of RDO. But, so far no decision is made. Having waited for considerable time, this writ petition is filed.

Since a Revision is already preferred by the petitioner and the same is pending consideration, this Court is not inclined to entertain the writ petition and keep it pending. 4.

Having regard to the above, the Writ Petition is disposed of directing the Joint Collector, Nizamabad, to dispose of the revision petition, as expeditiously as possible, preferably within a period of eight (8) weeks from the date of receipt of copy of this order after affording due opportunity to the 6th respondent. For any reason the Joint Collector cannot dispose of the Revision within the time fixed above, he shall consider the interlocutory application filed by the

- 3 - petitioner. In the event of Joint Collector considering the interlocutory application only and not the revision petition per se, he shall consider the same and pass appropriate orders within a period of three (3) weeks from the date of receipt of copy of this order. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
