THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3064 of 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioners on bail, who are arrayed as accused No.1 and 2, registered for the offences punishable under Sections 8 (c) r/w.20 (b) of Nactoric Drug and Psychotropic Substances Act ("NDPS Act" for brevity). 2.

Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The learned Counsel for the petitioners submits that, the petitioners were found in possession of 6 Kgs of Ganja on 15.03.2022 by Excise Police at Togggudem Railway Station. The seized quantity is less than commercial quantity and the Public Prosecutor submits that there are no other cases pending against these petitioners. For the said reason, the petitioners can be released on bail.

Accordingly, this petition is allowed, and the petitioners 1 and 2/Accused No.1 and 2 are directed to be released on bail on their executing personal bonds for Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum, to the satisfaction of the Judicial Magistrate of First Class, Manuguru. The petitioners shall appear before the concerned Police on every Friday for a period of three months. Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
