HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.9946 OF 2018 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents in not declaring the medical fitness of the petitioner as per the Mines Act, 1952 and its Rules 1955, as illegal and arbitrary and consequently declare that petitioner is unfit for the service of the respondent as he is suffering with 'Cardio Vascular Problem'.

Heard learned counsel for the petitioner.

Sri J.Srinivasa Rao, learned Standing Counsel for respondents submits that even according to the document filed by the petitioner at page 26 of the writ affidavit, the date of retirement of petitioner is 20.03.2018 and the writ petition is filed on 23.03.2018, and as such, question of referring the petitioner to Medical Board does not arise.

In view of the above, no purpose of would be served in referring the petitioner to Medical Board and I do not see any reason to entertain the writ petition.

Accordingly, the writ petition is dismissed. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. ____________________________ A.RAJASHEKER REDDY, J 10.04.2018 tk
