THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1816 of 2016 ORDER:
The petitioner, who is the sole accused in Crime No.463 of 2016 of Government Railway Police Station, Vijayawada, registered for an offence punishable under Section 379 of IPC, filed the present application under Sections 437 and 439 of the Code of the Criminal Procedure (Cr.P.C.), seeking enlargement on bail in the above crime. A charge sheet came to be filed against the petitioner for an offence punishable under Section 379 of IPC.
At the time when the matter is taken up for hearing, the learned Public Prosecutor placed on record material showing the involvement of the petitioner in 25 cases of similar nature. Out of 25 cases, 17 theft cases are pending in Bhopal Government Railway Police Station, M.P.State, 1 theft case is pending in Itarsi, M.P. and 7 theft cases are pending in Kalyan Government Railway Police Station, Mumbai, Maharastra State.
Insofar as A.P. is concerned, two crimes are registered.
As the petitioner is alleged to have involved himself in 37 cases of similar nature, in different parts of the country, and if the petitioner is released on bail, there is every likelihood of he jumping bail, I am not inclined to consider the request of the petitioner.
