HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 6515 of 2004 ORDER:
This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondents in not taking any sort of action on the representation of the petitioner dated 24.09.2002 and in not paying the arrears of salary, pensionary benefits of late Y.N.Prasad, S.I., Badge No.2216, Kurnool District, who is eldest son of the petitioner and in not giving compassionate appointment to the 2nd son of the petitioner, as illegal and arbitrary.
This Court directed the respondents to expeditiously process the terminal benefits payable to the deceased employee, vide orders dated 21.04.2004 in WPMP No.8438 of 2004.
Having gone through the record and in the facts and circumstances of the case, this Court is of the view that the writ petition can be disposed of with a direction to the petitioner to submit a representation to the respondents seeking pensionary benefits. Accordingly, the writ petition is disposed of directing the petitioner to submit a representation afresh to the respondents seeking disbursement of pensionary benefits, if not already disbursed, within two weeks from the date of receipt of a copy of this order, and upon receiving such representation, the respondents shall consider and pass appropriate orders thereon within four weeks thereafter.
Consequently, miscellaneous petitions pending, if any, shall stand closed. No order as to costs.
