THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.5414 OF 2013 ORDER:

1. This petition is filed by the petitioners-accused Nos.1 to 5 under Section 482 Cr.P.C., seeking to quash the proceedings in Crime No.77 of 2013 of Women Police Station, Cyberabad, registered for the offence punishable under Sections 498-A, 506, 324 IPC and Sections 3 & 4 of the Dowry Prohibition Act.

2. When this matter is taken up, the petitioners and the 1st respondent-complainant, who appeared before this Court, submitted through the learned Counsel for the petitioners that they entered into compromise and therefore, the proceedings in the above crime may be quashed. The 1st respondent-complainant stated before this Court that the 1st petitioner is her husband and petitioners 2 to 5 are his relations and she lodged a complaint against the petitioners and the same was registered as Crime No.77 of 2013 and subsequently, on the intervention of elders, she entered into compromise with the petitioners and she received permanent alimony from the petitioners and therefore, she is not interested to get the petitioners prosecuted further. The statement of the 1st respondent was recorded in open court separately.

3. In view of the statement of the 1st respondent-complainant, this Court feels that the continuance of the proceedings against the petitioners is nothing but a futile exercise and therefore, the proceedings against the petitioner can be quashed.

4. Accordingly, the Criminal Petition is allowed quashing the proceedings against the petitioners in Crime No.77 of 2013 of Women Police Station, Cyberabad. Consequently, miscellaneous petitions pending, if any, shall stand closed.
