THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO M.A.C.M.A.MP.(SR).No.37110 of 2015 IN/AND M.A.C.M.A.No.4402 of 2008 JUDGMENT:

This appeal was filed by the Andhra Pradesh State Road Transport Corporation, Hyderabad challenging the Award in O.P.No.841 of 2005 dated 16.08.2007 on the file of the Court of XVII Additional Chief Judge-cum-III Additional Metropolitan Sessions Judge, Hyderabad.

2. When the matter was referred to Lok Adalat, Hyderabad with the consent of the parties, appellant and respondents 1 to 3, an Award was passed on 24.09.2014.

Under the said Award, the claimants (respondents 1 to 3 herein) agreed to receive reduced compensation of Rs.85,000/- along with interest @ 7.5% per annum from the date of petition till the date of realization against 50% of the awarded amount i.e., Rs.1,00,000/-.

3. Now an application i.e., M.A.C.M.A.MP.(SR).No.37110 of 2015 is filed seeking to recall the said Award. Such an application in respect of Lok Adalat is not maintainable and therefore M.A.C.M.A.MP.

(SR).No.37110 of 2015 is dismissed. As the matter was referred to Lok Adalat, Hyderabad and an Award was passed, the main appeal is disposed of in terms of the Award dated 24.09.2014. Miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
