THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.9971 of 2018 ORDER:

This Writ Petition is filed questioning the action of the respondents 2 and 3 in not registering a crime against respondent No.4 on the report lodged by the petitioner, on 21.05.2016, inspite of repeated requests made thereafter by the petitioner for registration of the crime in accordance with the procedure established by law. 2.

I have heard the submissions of Sri N.V.R. Amarnath, learned counsel for the petitioner, and of the learned Government Pleader for Home (A.P) appearing for the respondents. I have perused the material record.

Learned counsel for the petitioner would submit that the petitioner is the owner of the land in an extent of 546 sq. yards in Sy.No.139/1A situate in Khaja Village Panchayat limits and that when there was unnecessary interference by respondent No.4 after indulgence by him in certain criminal actions, the afore-stated report is lodged by the petitioner way back in the year 2016 and that till date, even a crime has not been registered on the said report of the petitioner.

Learned Government Pleader for Home (A.P), on oral instructions, would submit that no such report is lodged with the police and that the petitioner has also not filed, along with the writ petition, an acknowledgment or endorsement showing receipt of the

report, dated 21.05.2016, by the Station House Officer, Old Guntur Police Station.

In reply, the learned counsel for the petitioner would submit that the petitioner is prepared to furnish a copy of the afore-stated report to the police or, in the alternative, lodge a fresh report with the police and that the police may be directed to do the needful in the matter.

Accordingly, the Writ Petition is disposed of reserving liberty to the petitioner to furnish a copy of the report, dated 21.05.2016, to the Station House Officer, Old Guntur Police Station, or, in the alternative, lodge a fresh report with the said Police Officer to enable him to do the needful in the matter in accord with the procedure established by law.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
