HONOURABLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.3696 OF 2018 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C by the petitioners/accused seeking to quash the proceedings against them in Crime No.47 of 2018 of Kothavalasa Police Station, Vijayanagaram District, registered for the offences under Sections 3(1) (r) (s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015. Investigation is reported to be pending. Learned counsel for the petitioners while producing the copy of order in Crl.P.No.3692 of 2018, would submit that in connected crime No.46 of 2018, this Court earlier passed an order in Crl.P.No.3692 of 2018 and prayed that the similar orders may be passed in this matter also.

Learned Additional Public Prosecutor does not object for the submission of the learned counsel for the petitioners. Perused the order in Crl.P.No.3692 of 2018.

This Criminal Petition is ordered to the effect that investigation shall go on. However, having regard to the nature of the accusation, the Investigating Officer shall strictly follow the guidelines of the Apex Court rendered in ARNESH KUMAR Vs. STATE OF BIHAR (1) and also follow the provision under Section 41-A Cr.P.C. towards the petitioners. In turn, the petitioners shall cooperate with the investigating agency for smooth completion of investigation. Accordingly, this Criminal Petition is disposed of. 1 2014 (3) ACR 2670 (SC)

As a sequel, miscellaneous applications pending if any, shall stand closed.
