THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.3210 of 2019 ORDER:
This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/accused Nos.1 and 2 seeking to quash the proceedings in Crime No.171 of 2019 of Sadasivapet Police Station, Medak District, registered for the offences punishable under Sections 270 and 273 I.P.C and Section 20 (2) of the Cigarettes and other Tobacco Products Act, 2003 (for short, 'the Act').

Heard the learned counsel for the petitioners/Accused Nos.1 and 2, learned Additional Public Prosecutor representing the respondent-State and perused the record.

Learned counsel appearing for the petitioners/accused Nos.1 and 2 would submit that in similar circumstances this Court vide common order, dated 27.08.2018, in Crl.P.No.3731 of 2018 and batch quashed the proceedings against the petitioners therein for the offences punishable under Sections 270 and 2073 I.P.C while permitting to proceed with for the offence punishable under Section 20 (2) of the Act. Learned Additional Public Prosecutor does not dispute the same.

Following the said order and for the reasons stated therein, this Criminal Petition is also allowed in-part quashing the proceedings in Crime No.171 of 2019 of Sadasivapet Police Station, Medak District, against the petitioners/accused Nos.1 and 2 for the offences punishable under Sections 270 and 273 I.P.C only, however, the
further proceedings shall go on in respect of the offence punishable under Section 20 (2) of the Act.
Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
