SMT. JUSTICE T. RAJANI TRANSFER CRIMINAL PETITION No.155 OF 2013 ORDER:

This Transfer Criminal Petition, under Section 407 of the Code of Criminal Procedure, 1973 (for short 'Code'), seeking for transfer of Calendar Case No.351 of 2012, pending on the file of the IV Additional Chief Metropolitan Magistrate at Nampally, Hyderabad, re-numbered as Calendar Case No.155 of 2012, pending on the file of the IX Special Magistrate at Erramanzil, Hyderabad to be heard along with Calendar Case No.325 of 2013, pending on the file of III Metropolitan Magistrate, Ranga Reddy District at L.B. Nagar.

2. Heard Sri Syed Khader Mastan, learned counsel for the petitioner, and the learned Public Prosecutor. None appears for respondent No.2 despite entered appearance.

3. Transfer of the aforesaid case is sought for on the ground that Calendar Case No.325 of 2013, which is pending on the file of the III Metropolitan Magistrate, Ranga Reddy District at L.B. Nagar is filed by the petitioner herein against respondent No.2. But, respondent No.2 herein who is accused in Calendar Case No.325 of 2013 is resident of Nallakunta, Hyderabad, and the case filed by him in Calendar Case No.351 of 2012 renumbered as C.C. No.155 of 2012 is first in point of time.

4. Therefore, the Calendar Case No.325 of 2013, pending on the file of the III Metropolitan Magistrate, Ranga Reddy District at L.B. Nagar is withdrawn from its file and transferred to the Court of IX Special Magistrate at Erramanzil, Hyderabad to be tried along with Calendar Case No.155 of 2012.

5. Accordingly, the present Transfer Criminal Petition is disposed of.
