Heard the learned counsel for the petitioner as well as the counsel for respondent No.1.

The present Criminal Revision Case is filed questioning the orders passed on 1.3.2018 in Crl.M.P.No.1062 of 2017 in M.C.No.41 of 2015 on the file of the Court of Judge, Principal Family Court, Vijayawada.

The facts of the case are that pursuant to the orders passed in M.C.No.41 of 2015 dated 1.7.2015, respondent No.1 filed Crl.M.P.No.1062 of 2017 under Section 125 (3) of Cr.P.C. to direct the petitioner to pay arrears of maintenance amount of Rs.1,65,000/- to her with effect from 10.11.2016 to 9.10.2017, failing which, to issue a distress warrant and sentence the petitioner herein to imprisonment.

Pursuant to the said petition, the Judge, Principal Family Court, Vijayawada, passed order on 1.3.2018, directing the petitioner to pay Rs.1,65,000/- and posted the matter to 20.3.2018. Aggrieved by the same, the present Criminal Revision Case is filed. 5.

However, in the light of the orders passed in Crl.Rc.No.3184 of 2015 filed against the orders passed in the maintenance case, the docket order dated 1.3.2018 is set aside. It is needless to observe that as directed by this Court on 9.3.2016 in Crl.Rc.M.P.No.4846 of 2015 in Crl.R.C.No.3184 of 2015, the petitioner shall continue to pay

the interim maintenance @ Rs.6,000/- p.m. till disposal of the maintenance case. The petitioner is also directed to pay the arrears of maintenance accrued @ Rs.6,000/- p.m. from the date of filing of the petition till date, within a period of six weeks from the date of passing of the order.

With the above said observations, Criminal Revision Case is disposed of.

Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
