HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3067 OF 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioner - Accused No.3 seeking bail in the event of his arrest in connection with Crime No.280 of 2021 on the file of Kataram Police Station, Jayashankar Bhupalpally District registered for the offences punishable under Section 9(c) read with Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act 1985.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

Briefly the facts of the case are that the Police arrested the accused No.1 and 2 and seized 35 grams of ganja, which is less than the small quantity (one kg. is small quantity). On the basis of the confession of accused No.1 and 2 that they purchased the said 35 grams of ganja from this petitioner,

the petitioner is arrayed as accused No.3. In the remand report of accused No.1 and 2 who are already released on bail, there is no specific allegation made against this petitioner except stating that accused No.1 and 2 confessed about the involvement of accused No.3. In the said circumstances, keeping in view that the petitioner is a student, the petitioner can be granted anticipatory bail. 4.

The Criminal Petition is accordingly allowed and the petitioner/accused No.3 is granted anticipatory bail subject to the following terms and conditions:

(1) The petitioner/accused No.3 is directed to surrender before the Station House Officer, Kataram Police Station, Jayashankar Bhupalpally District and on such surrender, the said Station House Officer shall release the petitioner/accused No.3 on bail on his executing a personal bond to the tune of Rs.20,000/- (Rupees twenty thousand only) with two sureties to the like sum each to his satisfaction. (2) The petitioner/accused No.3 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case.

(3) The petitioner shall attend the concerned police on every Monday for a period of two months.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
