Syed Jafar, v. State Of Andhra Pradesh, Rep. By Its Principal Secretary
THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.6696 OF 2016 O R D E R :
This Writ Petition is filed by the petitioner alleging inaction of the 3rd respondent in considering the petitioner's application dt.05.10.2015 for correction of mistakes in Online Land Records being maintained by the respondents in respect of the petitioner's land.
2. Petitioner alleges that his land is of an extent of Acs.2-08 cents in survey No.837/3 of Muthyalapadu Revenue Village, Lingasamudram Mandal of Prakasam District, but in the Online Land Revenue Records maintained by the respondents, the petitioner's land is wrongly mentioned as Ac.1.00 cents in survey No.195/1C of the same village.
3. Counsel for the petitioner states that under Sub-Section (6) of Section (5) of the Andhra Pradesh Rights in Land and Pattadar Passbook Act, 1971, the 3rd respondent is obligated to correct clerical errors and in spite of the fact that the petitioner had submitted application on 05.10.2015 and more than five moths have elapsed since then, nothing has been done by the 3rd respondent.
4. The Government Pleader for Revenue appearing for 3rd respondent assures that the 3rd respondent will pass orders on the petitioner's application dt.05.10.2015 for correction of the mistakes in Online Land Revenue Records being maintained by the respondents.
5. Having regard to the said submission, this Writ Petition is disposed of directing the 3rd respondent to pass orders on the petitioner's application dt.05.10.2015 with regard to the correction of the mistake in online Land Revenue Records in respect of petitioner's land within a period of two (02) weeks from the date of receipt of a copy of this order and communicate his decision thereon to the petitioner. There shall be no order as to costs.
6. Consequently, Miscellaneous Petitions pending if any, shall stand closed. _______________________________ M.S. RAMACHANDRA RAO, J 02nd March, 2016.
