THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No. 3103 OF 2022 ORDER:

This Criminal Petition under Section 438 Cr.P.C. is filed by petitioners - Accused No.2 to 5, 7 and 8 seeking bail in the event of their arrest in connection with Crime No.40 of 2022 on the file of Ramannapet Police Station, registered for the offences punishable under Sections 307 and 341 read with Section 34 of Indian Penal Code. 2.
Heard the learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondentState and perused the record. 3.
It is the case of prosecution that the defactocomplainant went to the police station on 5.3.2022 filed complaint stating that when he was travelling in his car along with his family, several persons including these petitioners, overtook his car and tried to kill him.
However, the defacto complainant escaped and went to the police station.

Admittedly, there are no injuries which are caused to the defacto complainant and further accused No.1 and 6 who are arrested were released on bail. The custodial interrogation of these petitioners may not be required, for which reason, the petitioners can be granted anticipatory bail.

The Criminal Petition is accordingly allowed and the petitioners/accused No.2 to 5, 7 and 8 are granted anticipatory bail subject to the following terms and conditions:
(1) The petitioners/accused No.2 to 5, 7 and 8 are directed to surrender before the Station House Officer, Ramannapet Police Station, within ten days from the date of this order and on such surrender, the said Station House Officer shall release the petitioners/accused No.2 to 5, 7 and 8 on bail on their executing personal bond to the tune of Rs.10,000/- (Rupees Ten thousand only)
with two sureties to the like sum each to his satisfaction.
(2) The petitioners/accused No.2 to 5, 7 and 8 shall abide by the other conditions stipulated in Section 438(2) Cr.P.C and co-operate with the Investigating Officer in investigating the case. (3) The petitioners shall attend the concerned police on every Wednesday for a period of eight weeks.
Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
