HON'BLE SRI JUSTICE U.DURGA PRASAD RAO WRIT PETITION No.6083 OF 2014 ORDER:

The petitioner seeks writ of mandamus declaring the action of the respondents in interfering with the petitioner's house property admeasuring 226 square yards bearing House No.4-189(old) and 4-499 (new) in Railway Station Residential Area, Piler Village and Mandal, Chittoor District, without following due process of law as illegal, arbitrary and unconstitutional and consequently, direct the respondents not to interfere with the aforesaid house property without following due process of law.

This Court, while admitting the writ petition, granted interim order on 04.03.2014 in W.P.M.P.No.7566 of 2014, which reads as follows:

"Prima facie, the petitioner claims to have been residing in a constructed house bearing No.4-189, railway station road piler village and mandal, Chittoor District in a residential area as per the building plan granted by Panchayat Secretary, Piler Gram Panchayat, dated 15.10.2004. The third respondent shall not interfere with the petitioner's possession except by giving notice. Notice.

Post after three weeks."

Learned Government Pleader for Revenue took notice for respondents. No counter so far filed.

When the matter came up for hearing, learned Government Pleader, on instructions, would submit that so far the respondent authorities have not caused any threat to the petitioner in respect of the subject house property and if at all they propose to interfere with the said property, they will scrupulously follow the due process of law. 5.

In view of the above submission of learned Government Pleader, this writ petition is disposed of in terms of the above interim order earlier passed by this Court. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
