THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 3077 of 2022 O R D E R:

This Criminal Petition is filed under Sections 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner, who is arrayed as accused No.5, on bail in connection with Crime No.108 of 2022 of Pahadisharif registered for the offences punishable under Sections 394, 342, 506, 413, 411 r/ws.34 of Indian Penal Code and Section 25 of (1) of Arms Act.

Heard the learned counsel for the petitioner and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The case of the prosecution is that on 15.2.2022 at about 11 p.m the complainant loaded his container Br.No.NL01/AD/4374 with MRF tyres and was proceeding towards Haryana and on the way when the container reached Trichi, the complainant slept by handing over driving to the cleaner-Sohel and when they reached near Thipparthi village of Nalgonda District, one of the unknown persons, who boarded the container, threatened the cleaner on the point of

gun and tied the hands of the complainant and cleaner and committed theft of property worth Rs.37,45,085/- 4.

The learned Counsel for the petitioner submitted that, A1, A4 and A6 were already granted regular bail. According to the Assistant Public Prosecutor there are no other criminal cases pending against this petitioner. On the ground of parity, the petitioner can be released on bail.

In the said circumstances, the petitioner/Accused No.5 is directed to be released on bail on his executing personal bonds for Rs.50,000/- (Rupees fifty thousand only), with two sureties each for like sum to the satisfaction of the Principal Junior Civil Judge-cum-Metropolitan Magistrate, Cyberabad, Hyderabad. The petitioner shall appear before the police concerned, on every Tuesday and Thursday for a period of three months.

Accordingly, the Criminal Petition is allowed. As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
