PC: (Per Hon'ble Sri Justice S.V. Bhatt) Heard learned counsel for the petitioners.

The petitioners pray for a mandamus declaring the public hearing scheduled on 25.3.2015 on the proposed project of 4th respondent as contrary to the Environmental Impact Assessment Notification, 2006. Learned counsel for the petitioners, at the time of hearing, having tried to persuade us on the alleged illegalities in the conduct of public hearing, alternatively submitted that under the procedure stipulated in Appendix IV of Environmental Impact Assessment Notification, 2006, fair and reasonable opportunity is to be afforded to project affected persons. The petitioners are satisfied if an opportunity is given to forward their objections on the project through the Environmental Engineer (APPCB), Visakhapatnam to the State Environmental Impact Assessment Committee (S.E.A.C.).

Having regard to the limited submission of the learned counsel for petitioners, the petitioners are given thirty (30) days from today to forward/submit their objections in pursuance of the notification dated 21.2.2015 on the proposed project of 4th respondent to S.E.A.C. through the Environmental Engineer, Visakhapatnam and he is directed to forward the objections to the S.E.A.C. for consideration. The writ petition is disposed of as indicated above. Consequently, miscellaneous petitions, if any, also stand disposed of. No costs.
