HON'BLE SRI JUSTICE RAJA ELANGO Writ Petition No.20306 of 2017 O R D E R :

The Writ Petition is filed under Article 226 of the Constitution of India seeking to issue a writ, order or direction, more particularly one in the nature of writ of Mandamus declaring the action of the 2nd respondent in trying to demolish the buildings bearing Nos.8-271 to 8-276 of Kalyandurg Municipality in pursuance of the Notice dated 31.3.2017, without conducting any enquiry and passing orders as directed by this Hon'ble Court in W.P.No.936 of 2009 dated 4.6.2009, as illegal and arbitrary and consequently, direct respondents not to demolish the said buildings without following due process of law. 2.

Heard Sri K.Sitaram, learned counsel for the petitioner, learned Government Pleader for Municipal Administration appearing on behalf of the respondent No.1 and Sri Md.Saleem, learned Standing Counsel for the respondent No.2-Municipality and perused the material available on record.

Sri K.Sitarm, learned counsel for the petitioner, informed that the petitioner has already submitted his representation and requests this Court to direct respondents to consider petitioner's representation and pass appropriate orders in accordance with law.

Considering the said request, if the said buildings have already not been demolished, respondents are directed to take appropriate steps in the matter in accordance with law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Consequently, Miscellaneous Petitions pending, if any, in the Writ Petition shall stand closed.
