ORDER:

This Criminal Petition is filed under Section 483 (1)(b) of the Bharatiya Nagarik Suraksha Sanhita (for short 'BNSS') to relax the condition imposed by the trial Court vide order dated 01.08.2025 passed in Crl.M.P.No.1152 of 2025 in Crime No.1039 of 2025 by the I Additional District and Sessions Judge, Medchal-Malkajgiri District.

Heard Sri S. Chandrashekar Yadav, learned counsel for the petitioner and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent - State.

Learned counsel for the petitioner submitted that the trial Court while allowing the Crl.M.P.No.1152 of 2025 directed the petitioner to comply the conditions passed therein. Learned counsel further submitted that condition i.e., the petitioner shall enlarge on bail on executing the personal bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum to the satisfaction of the learned IX Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District. He further submitted that the petitioner cannot afford to furnish surety and prayed the Court to modify the said condition.

Having regard to the submissions made by the learned counsel for the petitioner, this Court is inclined to modify the order dated 01.08.2025 passed in Crl.M.P.No.1152 of 2025 in Crime No.1039 of 2025, the condition i.e., the petitioner shall enlarge on bail on executing the personal bond of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties for a like sum to the satisfaction of the learned IX Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District to that of condition i.e., the petitioner shall enlarge on bail on executing the personal bond of Rs.5,000/- (Rupees Five Thousand Only) with two sureties for a like sum to the satisfaction of the learned IX Additional Judicial Magistrate of First Class, Medchal-Malkajgiri District.

With the above modification, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall also stand closed.
