THE HONOURABLE SRI JUSTI CE SANJAY KUMAR WRI T PETI TI ON NO.12059 OF 2019

O R D E R

The petitioner is aggrieved by the action of the revenue authorities in not mutating his name in the revenue records in relation to the land admeasuring Ac.10.29 guntas in Survey No.27/1 and Ac.16.11 guntas in Survey No.276 of Tosham Village, Gudihatnoor Mandal, Adilabad District, based on the Hiba dated 23.10.2018.

Perusal of the record however reflects that the petitioner did not make an application in Form VI(A) as required by Section 4 of the Telangana Rights in Land and Pattadar Pass Books Act, 1971 read with Rule 18 of the Telangana Rights in Land and Pattadar Pass Books Rules, 1989. Without adhering to the prescribed procedure, it is not open to the petitioner to complain of inaction on the part of the revenue authorities. In that view of the matter, the writ petition is disposed of permitting the petitioner to make an application online in Form VI(A) along with the requisite fee and necessary documents. Upon receipt of such an application, the Tahsildar, Gudihatnoor Mandal, Adilabad District, shall take appropriate action thereon in accordance with law expeditiously and in any event, not later than four weeks from the date of receipt of a copy of this order, be it from whatever source. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs. _______________ SANJAY KUMAR, J 19th JUNE, 2019 Svv
