I.A.No.1 of 2025 This application is filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), seeking to relax the condition imposed by this Court while granting regular bail in favour of the petitioner/accused No.2 in Crl.P.No.5352 of 2025.
Heard Ms. Divya Raj, learned counsel for the petitioner/accused No.2 and Mr. Syed Yasar Mamoon, learned Additional Public Prosecutor appearing for the respondent/State.
Learned counsel for the petitioner submits that the petitioner is accused No.2 in Crime No.3055 of 2024 on the file of Cyber Crime Police Station, Hyderbad and the petitioner approached this Court by filing Criminal petition No.5352 of 2025 for grant of regular bail and this Court allowed the said
petition on 24.04.2025 with certain conditions. Accordingly, the petitioner has complied all the conditions and is appearing before the concerned SHO on every Monday at 11.00 A.M. since last four weeks.
He further submits that the petitioner is native of Gujarat and is doing finance. The petitioner has already submitted all the documents which are available with him and the police recorded the statement of the petitioner and his presence before the concerned SHO is not required and if the said condition is not relaxed, the petitioner will be put to great hardship and requested to relax the said condition.
Learned Additional Public Prosecutor has not opposed the same.
Taking into consideration the facts and circumstances of the case and also in view of the submissions made by the learned counsel for the petitioner, as the petitioner has already appeared before the SHO for a period of four weeks and submitted all the documents and the police recorded the said appearance, the condition imposed by this Court in order
dated 24.04.2025 directing the petitioner/accused No.2 to appear before the concerned SHO is relaxed and the other conditions made in the above order remains unaltered.
Accordingly, I.A.No.1 of 2025 is allowed.
