HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.32263 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus challenging the proceedings issued by the third respondent dated 26.08.2016 as being illegal and arbitrary.

Heard Sri D.Kanakasundar, learned counsel for the petitioner, Sri A.K.Jayaprakash Rao, learned Standing counsel representing the respondents 2 and 3, the learned Government Pleader for Endowments (Andhra Pradesh) representing the first respondent and the learned Government Pleader for Labour (Andhra Pradesh) representing the fifth respondent.

The grievance of the petitioner is that the third respondent issued proceedings in ROC.No.C6/ 7367/ ACV&SO/ TTD/ TPT/ 2016 dated 26.08.2016 permitting the private parties to ply the vehicles from Tirupathi to Tirumala. A perusal of the record reveals that the fifth respondent granted permission to third parties to ply the lorries (Four in number) with effect from 01.09.2016 to 30.09.2016. It appears there is some dispute between the petitioner and other union, i.e. fourth respondent. This Court cannot go into the disputed question of fact while exercising the jurisdiction under Article 226 of the Constitution of India. The respondents 1 to 3 are the competent persons to resolve the disputes between the petitioner and the fourth respondent. A perusal of the record reveals that the petitioner herein submitted a representation to the second respondent on

20.05.2016. For one reason or the other, the second respondent has not disposed of the representation of the petitioner. 4.

At the time of arguments, the only relief sought by the petitioner is to direct the second respondent to dispose of the representation of the petitioner dated 20.05.2016 as early as possible. Learned standing counsel also consented for the same. 5.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. 6.

Having regard to the facts and circumstances of the case and also the submissions made by both the counsel, the second respondent is hereby directed to dispose of the representation of the petitioner dated 20.05.2016 in accordance with law as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.

With the above direction, the writ petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
