THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4673 OF 2016 ORDER:

This petition is filed by the petitioners-accused under Section 482 Cr.P.C. seeking to quash the proceedings against them in Crime No.52 of 2016 on the file of Yerraguntla Police Station, YSR Kadapa District, registered for the offence punishable under Sections 323, 354 r/w 34 IPC and Section 3(1)(r)(w)(i) of the SCs & STs (POA) Amendment Act, 2015.

Heard and perused the material available on record. It is alleged that the petitioners assaulted the husband of the 2nd respondent with hands and legs and when the 2nd respondent tried to rescue her husband, both the accused dragged her by holding her tuft of hair in the street and used abusive words by insulting her modesty and they also abused her in the name of her caste in the public place. Learned Counsel for the petitioners submitted that the 2nd respondent and her husband are working in the industrial unit of the petitioners and they took hand loan of Rs.1,10,000/- from the 1st petitioner and when the 1st petitioner demanded to repay the amount, the 2nd respondent filed a false complaint against them to avoid payment of the hand loan amount.

Considering the facts and circumstances of the case and the allegations made against the petitioners, this Court is not inclined to grant the relief sought by the petitioners.

However, the 1st respondent-police are directed to complete the investigation and file a final report, if any, in accordance with law, without arresting the petitioners. In the event of necessity, the 1st respondent-police are directed to issue notice to the petitioners for the purpose of investigation. On issuance of such notice, the petitioners are directed to appear before the investigating officer and give an undertaking as to

their future appearance as and when required by the investigating agency for the purpose of investigation.
