ORDER:

This Criminal Petition is filed before this Court for grant of bail to the Petitioners who are arrayed as accused Nos.1 and 2 in Crime No.73 of 2026 of Nakrekal Police Station, Nalgonda District, registered for the offences punishable under Sections 108 r/w 3(5) of the Bharatiya Nyaya Sanhita (for short 'BNS').

The brief facts of the case are that, on 17.03.2026, the de-facto complainant lodged a report before the police stating that, due to a long-standing land access dispute, the accused persons obstructed pathway to his agricultural land and abused, threatened and harassed the de-facto complainant's family. It is further stated that the accused attempted to coerce sale of land at a low price. Due to continuous harassment and humiliation, the complainant's son committed suicide on 17.03.2026. Hence, the complainant requested to take necessary action. Based on the said complaint, the police registered a case against the petitioners for the aforementioned offences.

Heard Sri K. Shrikanth Reddy, learned counsel appearing on behalf of the petitioners as well as Sri M. Ramachandra Reddy, learned Additional Public Prosecutor for respondent-State.

Learned counsel for the petitioner submitted that the petitioners are falsely implicated in the present case and that there is no such abatement committed by the petitioners with regard to the civil disputes. The

petitioners are in jail from 26.03.2026 and the material part of the investigation is already completed. It is further submitted that the petitioners are senior citizens and are ready to co-operate with the investigating authority. Therefore, he prayed the Court to grant bail to the petitioners by allowing this criminal petition. 5.

On the other hand, learned Addl. Public Prosecutor opposing the petition stating that the alleged offences are serious in nature and the material part of the investigation is not yet completed. Therefore, he prayed the Court to dismiss the petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the petitioners are in jail from 26.03.2026, who are arrayed as accused Nos.1 and 2 and as seen from the record LW1 to LW17 were examined. Considering the facts and circumstances of the case, the nature of the allegations, the stage of investigation, and the duration of incarceration, this

Court finds it appropriate to grant bail to the petitioners, subject to the following conditions.

i.

The petitioners shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), each with two sureties for a like sum each to the satisfaction of the learned Judicial First Class Magistrate at Nakrekal.

ii.

The petitioners shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed.

Miscellaneous applications, if any pending, shall stand closed.
