THE HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.1796 of 2006 ORDER:

Heard the learned counsel for the petitioner. The present Criminal Revision Case is filed questioning the orders passed in M.C.No.69 of 2005 dated 31.7.2006 on the file of the Additional Metropolitan Sessions Judge for the trial of JHCBBC-cumAdditional Family court at Hyderabad awarding a sum of Rs.4,000/- each to the petitioners.

When the matter is called, during the course of hearing, it is informed by the learned counsel for the petitioners that the parties have already settled the matter and they are going to live together. In such circumstances, this Court is of the opinion that pendency of the present criminal revision case should not become an impediment for them to settle the issue. Apart from the same, the order impugned is passed in the month of July, 2006 and the learned counsel for the petitioners has rightly contended that after a gap of more than 12 1⁄2 years there are changed circumstances which requires the petitioners to file a fresh application if no compromise is effected. Acceding to the request of the learned counsel for the petitioners, the Criminal Revision case is closed giving liberty to the petitioners to move a separate application for enhancement of maintenance as per law in the event of the compromise not being materialized.
