HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.1923 of 2015 ORDER:
The petitioner/accused filed the present application under Section 438 Cr.P.C., seeking release in the event of his arrest in connection with Crime No.1306 of 2014 of Panjagutta Police Station, Hyderabad, registered for the offences punishable under Sections 406, 420 and 408 IPC r/w Section 156 (3) Cr.P.C.
The case of the prosecution is that on 27.12.2014 a report came to be lodged by the complainant stating that the accused was entrusted with a job to receive purchase order from the customers, raise invoices and send the consignment of C.C. cameras by duly taking the signature of the authorized person. It is also stated that it is the responsibility of the accused to collect the payment and remit the same to the account of complainant. However, the accused is alleged to have raised fake invoices and sold C.C. cameras to third parties. Basing on these allegations, the above case came to be registered. Heard learned counsel for the petitioner and learned Public Prosecutor appearing for the respondent-State.
A perusal of the averments in the report would show that the accused is alleged to have raised fake invoices in the name of the company and C.C. cameras were sold to third parties and not to M/s. RGP Electronics India Private Limited. It is further alleged that the accused has admitted his guilt, of misusing his liberty as a branch manager and misappropriated the funds of the company, by duly signing on a bond paper dated 24.06.2014.
Having regard to the said circumstances, I am not inclined to grant anticipatory bail to the petitioner. However, the petitioner, if so advised, shall surrender before the appropriate Court and make an
application for bail, after giving prior notice to the learned Public Prosecutor, in which event, the same shall be dealt with, in accordance with law, at the earliest.
Accordingly, the criminal petition is dismissed. Miscellaneous petitions pending, if any, shall also stand closed. __________________ C. PRAVEEN KUMAR, J Date: 18.03.2015 ska
