ORDER:

The petitioner is an employee of Tirumala Tirupathi Devasthanams working in the capacity of Office Subordinate. By proceedings, dated 16.10.2014, the petitioner was dismissed from service. Against the order of dismissal, under Section 120(I) of the Charitable and Hindu Religious Institutions and Endowments Act, 1987 (Act 30 of 1987), right of appeal is created to the Board of Trustees of Tirumala Tirupathi Devasthanams. In terms thereof, the petitioner is stated to have filed appeal on 03.11.2014. The said appeal is not yet disposed of. Aggrieved thereby, this writ petition is filed.

2. Though the statute vests right of appeal against the order passed by the competent authority and that appeal is preferred by the petitioner as early as on 03.11.2014, it is unfortunate that so far, the same is not disposed of even though it is more than one year. Learned Standing Counsel representing the Tirumala Tirupathi Devasthanams states that large number of matters are pending before the Board of Trustees. The Board of Trustees is unable to process the appeal filed by the petitioner. Thus, this is an internal matter, but due to the delay on their part, the individual cannot suffer.

3. In view of the fact that the petitioner has preferred an appeal and the same is pending consideration before the appellate

authority, the Writ Petition is disposed of, without expressing any opinion on merits, directing the Board of Trustees, Tirumala Tirupathi Devasthanams to consider the appeal filed by the petitioner, as expeditiously as possible, in the next meeting of the Board of Trustees and pass appropriate orders, as warranted by law. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
