THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO Tr.C.M.P.No.118 of 2019 ORDER :

This Tr.C.M.P. is filed by petitioner seeking transfer of O.P.No.53 of 2018 on the file of Senior Civil Judge, Medak to the Family Court at Secunderabad.

Petitioner is wife of respondent and the said O.P. had been filed by respondent seeking divorce from the petitioner. 3.

Petitioner contends that petitioner is staying at Secunderabad with her parents, that she is solely depending on her parents and it is difficult for her to travel to Medak which is 100 K.Ms. away without any male assistance. She also stated that she has two small children and they are required to be taken care of.

Though petitioner has been permitted to serve notice on respondent by RPAD, the said notice sent by the counsel for petitioner has been returned with an endorsement "refused". Therefore respondent is deemed to be served.

Having regard to the difficulties expressed by petitioner in attending the proceedings in Medak on account of her staying at Secunderabad taking care of two small children, which is not rebutted by respondent, this Tr.C.M.P. is allowed; and O.P.No.53 of 2018 on the file of Senior Civil Judge, Medak is transferred to the Family Court at Secunderabad. No costs.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
