Heard.
The petitioner is the owner and driver of Auto bearing No.AP-20-W4371 and it was seized on 11-04-2015 while transporting 7 cans of Kerosene Oil. 6-A proceedings were initiated against the stock and the vehicle and the petitioner has submitted his representation on 11-05-2015 for release of Auto pending disposal of 6-A proceedings. As the vehicle is not being released by the 2nd respondent, the present writ petition is filed. From the documents filed along with the writ petition it is clear that the Auto is of the year 2005 and the petitioner is eking out his livelihood by running Auto. By retaining the Auto pending disposal of 6-A Proceedings, no useful purpose would be served.
In the circumstances, the 2nd respondent is directed to release the petitioner's Auto bearing AP-20-W-4371 on the petitioner furnishing bank guarantee/cash security for a sum of Rs.25,000/- (Rupees twenty five thousand only) within two weeks from the date of receipt of a copy of this order, and on the petitioner furnishing an undertaking that he will not sell the Auto during pendency of 6-A Proceedings and produce the same as and when required by the 2nd respondent.
