HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 3228 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in C.C.No.354 of 2019 on the file of the XIX Metropolitan Magistrate, Kukatpally, Cyberabad. 2.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners before the trial Court on every date of adjournment.

The learned Additional Public Prosecutor submits that accused No.1 is the husband and accused Nos.2 to 4 are in-laws of the de facto complainant and since the petitioners 2 to 4 are in-laws, their presence may not be necessary on every date of adjournment. 5.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners 2 to 4, who are in-laws of the de facto complainant in C.C.No.354 of 2019 on the file of the XIX Metropolitan Magistrate, Kukatpally, Cyberabad, is hereby dispensed with except on the dates when their presence is specifically required by the Court. It is made clear that petitioner No.1/ accused No.1, who is the husband of the de facto complainant should appear before the trial Court on every date of adjournment.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand dismissed.
