THE HON'BLE SRI JUSTICE SURESH KUMAR KAIT CRIMINAL PETITION No.15151 OF 2016 ORDER:

Vide present petition, the petitioner/Accused seeks a direction thereby to release him on bail in connection with Crime No.84 of 2016 of Kowdipally Police Station, Medak District, registered for the offences punishable under Sections 302, and 376 IPC.

Heard learned counsel for the petitioner/Accused and the learned Additional Public Prosecution on behalf of the respondent-State.

Learned counsel appearing on behalf of the petitioner/Accused submits that the name of the petitioner is not mentioned in the complaint, which is converted into FIR mentioned above.

A perusal of the FIR shows that the complainant has stated that he found his wife hanged by some unknown persons, because on that time, he was not aware what had happened to his wife, which is the subject matter of the investigation.

As stated by the learned counsel for the petitioner that simply the sniffer dog stopped in front of his wife. Accordingly, the police arrested him and impleaded falsely in the present case.

As stated by the learned Additional Public Prosecutor, the investigation is going on and the role of the petitioner would be ascertained.

At this stage, if the petitioner is admitted on bail, he may influence the witnesses and tamper with the evidence. Keeping in view nature of the crime, which is heinous registered under Section 366, 302, and as the investigation is at the advance stage, I am not inclined to grant bail. Accordingly, the Criminal Petition is dismissed. Miscellaneous Petitions, if any pending, shall stand closed.
