THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12120 OF 2019 Dated:16.07.2019 Between:
Tandra Venkateswara Rao, S/o. Late Tandra Gopal Rao, aged about 55 yeas, Occ: Agriculture, R/o.H.No.3-12/4, Kamalpur Village, Mangapet Mandal, Jaishankar Bhopalpaly District and others .. Petitioners And The State of Telangana, rep., by its Principal Secretary, Revenue Department, Secretariat, Hyderabad and others .. Respondents This Court made the following:
- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.12120 OF 2019 ORDER:
Heard learned counsel for the petitioners and learned Government Pleader for Revenue.
2.
According to petitioners, Tandra Narsaiah was the owner of the property to an extent of Acs.6.06 guntas in Survey No.150 of Chatakonda Village, Laxmidevipally Mandal, Bhadradrki Kothagudem District. After his death, his son, by name, Tandra Gopal Rao inherited the property and after death of Tandra Gopal Rao, petitioners succeeded to the said property. They allege that they intend to mutate their names in the revenue records and accordingly made an application before respondent No.4, but so far no action is taken. Earlier petitioners filed W.P.No.2240 of 2019. By order dated 06.02.2019, this Court disposed of the said Writ Petition granting liberty to the petitioners to make an application in prescribed proforma requesting to mutate their names.
They now allege that when they went to Mee-Seva Centre, Kothagudem, to file an application in Form VI-A, the officials of Mee-Seva said that the property was not reflected in online record and therefore their request to submit application in Form VI-A cannot be accepted. Subsequently, they made representation before the Tahsildar on 20.02.2019 and the same was acknowledged by the office on the same day. Alleging inaction, this Writ Petition is filed. 3.
Material on record would disclose that petitioners claim as owners of land and though they made application for mutation of their names in the revenue records, they were unsuccessful.
- 3 - According to their version, when they went to Mee-Seva Centre for uploading their application, their property was not displayed in the online records.
4.
Having regard to the peculiar facts of this case, the Tahsildar, Laxmidevipally Mandal, Bhadradri Kothagudem District, respondent No.4, is directed to examine the grievance of the petitioners as ventilated in their representation dated 20.02.2019 and furnish suitable reply. If the Tahsildar is of the opinion that due to clerical mistake or otherwise, the subject property is not reflected in the online register, the same be rectified granting liberty to the petitioners to apply in Form VI-A. If, according to Tahsildar, the land does not belong to the petitioners or is in the prohibited list, all the details be furnished to them and decision shall be taken and communicated to them within a period of four weeks from the date of receipt of a copy of the order. 5.
With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
