THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.10091 of 2018 ORDER:

This Writ Petition, under Article 226 of the Constitution of India, is filed by the petitioners seeking the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue an appropriate Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the respondent police herein in not taking any action against the respondent Nos.6 to 8 herein pursuant to the complaint dt. 02-02-2018, inspite of the repeated visits made by the petitioner, as being illegal, arbitrary, unjust and unconstitutional and consequently direct the respondent Nos.4 and 5 herein to forthwith act upon the complaint dt. 02-02-2018 and to take action against the respondent Nos.6 to 8 in accordance with Law, and to grant such other relief or reliefs as this Hon'ble Court deems fit and proper in the circumstances of the case and in the interest of justice." I have heard the submissions of Sri Shaik Jilani, learned counsel appearing for the petitioner, and of the learned Government Pleader for Revenue (Telangana) appearing for the respondents 1 & 2, and of the learned Government Pleader for Home (Telangana) appearing for the respondents 3 to 5. I have perused the material record.

Learned counsel for the petitioner would submit that despite lodging a report, dated 02.02.2018, the police have not registered a criminal case against the respondents 6 to 8. 4.

Learned Government Pleader for Home, on oral instructions, would submit that no report is lodged with the police as alleged in the writ petition and that along with the writ petition material papers, no acknowledgement or endorsement is produced to show

MSRM, J W.P.No.10091 of 2018 the alleged filing of the report, dated 02.02.2018, before the Police Officer concerned.

Having regard to the submissions, the Writ Petition is disposed of reserving liberty to the petitioner to lodge a fresh report with the Station House Officer of the Police Station concerned. It is needless to state that in the event the petitioner files any such report, the Police Officer concerned shall do the needful in the matter, in accordance with procedure established by law. There shall be no order as to costs.

Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
